Via the Sun Sentinel:

"Sunrise woman accused of taking her young daughter out of South Florida, partly to keep the girl from being vaccinated, will not be charged with kidnapping, prosecutors confirmed Friday. No decision has been reached on whether her boyfriend will be charged with that crime.
Megan Everett, 23, remains in a Broward jail cell in lieu of a $200,000 bond on charges of interference with custody and removing a minor from the state. Both are third-degree felonies punishable by a maximum of five years in prison.
Everett went missing in May after she took custody of her daughter, Lilly, now 3. Lilly's father, Robert Baumann, 27, of Davie, had a joint custody agreement and expected to be reunited with her a week after he dropped her off. But Everett vanished, and Baumann reported the child missing.
Everett was tracked down in Palatka on Aug. 3. She and her boyfriend, Carlos Carrie Lesters, were arrested on kidnapping and other charges.
But prosecutors said they were legally unable to charge Everett with kidnapping under the circumstances of her case. As the biological mother, she could only be charged with interfering with the shared custody agreement. Everett is scheduled to be arraigned on Monday.
Formal charges have yet to be filed against Lesters, and an arraignment has not yet been scheduled. He is due in court on Sept. 4 to ask for bail to be set. He is being held without bond pending the same charges faced by Everett, plus kidnapping."

Restoring the honor!
